1. Introduction

These Terms of Service ("Terms") govern your use of Agent 1-Up services. By using our platform, you agree to these Terms.

2. Eligibility

Agent 1-Up services are for users 18 years or older, intended solely for commercial marketing and lead generation use. Deployment for children's products or child-targeted properties is prohibited.

3. Service Scope

• Chatbot configuration for lead generation and conversions
• A/B Testing functionality
• Custom CSS support
• Widget placement configuration
• Code snippets for easy integration
• Reporting dashboards for conversation logs

4. Free Trials & Paid Plans

We offer a 30-Day Trial. The trial starts when a campaign is live and tracks either chatbot impressions (up to 5000 per day) or chat interactions (up to 200 per day). Each day the chatbot is active counts toward the 30-day limit, regardless of duration. Trials can be paused, extending up to 60 calendar days total.

Paid plans follow a usage-based pricing model, billed per AI tokens: approximately 4 tokens equal 3 words, charged at $0.005 per 1,000 tokens.

5. Billing, Refunds & Cancellations

• Billing occurs via credit card and utilizes auto-billing when credit balances run low.
• We will refund any unused credit for accounts in good standing that choose to end service.
• Account cancellation can be managed directly within the platform.
• Post-cancellation, refunds will be processed within 30 days.

6. Acceptable Use Policy

• Only for commercial marketing and lead generation purposes.
• No deployment on sites with illegal content or targeting children under 13.

7. Disclaimers & Limitations of Liability

• Agent 1-Up makes no guarantees regarding the accuracy of AI-generated content.
• We are not liable for user configurations or chatbot misuse.
• We offer a 99% uptime guarantee, excluding force majeure events and scheduled maintenance.

8. Termination of Service

We reserve the right to suspend or permanently terminate accounts that violate these Terms. Termination may result in loss of service access and data deletion.

9. Intellectual Property

All platform code and intellectual property are owned by Agent 1-Up. Clients retain ownership of their input data and content.

10. Governing Law

These Terms are governed by the laws of the United States and the state of [Insert State, e.g., Delaware].
